This Privacy Policy is issued by AM Foods & Beverages LLP, a limited liability partnership incorporated in India (LLPIN ACR-1163), having its registered office at First Floor, 28/36, Old Rajendra Nagar, New Delhi 110060, India (“1AM”, “we”, “us”, “our”). We own and operate the brand 1AM and the website at1am.com.
For the purposes of the Digital Personal Data Protection Act, 2023, we act as a Data Fiduciary in respect of personal data you provide to us directly.
This Policy applies to personal data we collect through at1am.com, our official email addresses, our official WhatsApp number, and any form, application or enquiry submitted to us.
This Policy does not apply to personal data you provide to third-party platforms on which our products are listed, including quick-commerce and marketplace platforms. Those platforms act as independent data fiduciaries in respect of your transaction with them and their own privacy policies govern that relationship. We receive only limited, aggregated or order-fulfilment information from them.
We process personal data in accordance with the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025 (as and when the relevant provisions commence), the Information Technology Act, 2000 together with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and, where applicable to online sales, the Consumer Protection (E-Commerce) Rules, 2020.
When you browse at1am.com. IP address, device and browser type, operating system, referring URL, pages viewed, session duration and approximate location derived from IP. Collected through cookies and similar technologies — see Section 13.
When you contact us or submit an enquiry. Name, email address, telephone or WhatsApp number, and the content of your message.
When you submit a trade or distribution enquiry. In addition to the above: business name, constitution, city and territory of operation, GSTIN, FSSAI licence number, brands currently carried, infrastructure details, and the name and designation of your point of contact. Where an enquiry progresses to onboarding we additionally collect the documents listed in our Terms of Appointment, which may include PAN, a cancelled cheque and constitution proof.
When you order merchandise or products directly from us. Name, delivery and billing address, telephone number, email address and order details. Payments are processed by a third-party payment gateway. We do not collect, store or have access to your full card number, CVV, UPI PIN, net-banking credentials or any other payment authentication data.
When you apply for a role, internship or campus ambassador programme. Name, contact details, institution, course and year, curriculum vitae, portfolio, social media handles, stated availability and the free-text answers you provide.
When you interact with us on social media or through creator collaborations. Handle, publicly available profile information, and content you share with or tag us in.
We do not knowingly collect biometric data, health data, financial account credentials, caste, religion, sexual orientation or political affiliation. Please do not send us such information.
We process personal data only for the following specified purposes: responding to your enquiries and providing customer support; evaluating, onboarding and administering trade and distribution relationships; processing, fulfilling and delivering orders and handling returns or replacement claims; evaluating applications for employment, internships and the campus ambassador programme; sending you marketing communications where you have consented; operating, securing and improving at1am.com; product quality investigation and batch traceability, including where required by a food safety authority; and complying with applicable law, including tax, food safety and legal metrology obligations, and enforcing our rights.
We do not sell personal data. We do not use personal data for automated decision-making that produces legal effects.
Where we rely on your consent, that consent is sought through a clear affirmative action and is specific to the purpose notified to you. You may withdraw consent at any time, with the same ease with which it was given, by writing to the Grievance Officer at the address in Section 12.
Withdrawal of consent is prospective. It does not affect processing already carried out, and it does not require us to delete data we are required by law to retain — for example transaction records retained under tax law, or batch and dispatch records retained for food safety traceability.
If you withdraw consent necessary for a service, we may no longer be able to provide that service.
The 1AM website and our marketing are directed at persons aged 18 and above. We do not knowingly collect personal data of a child, being a person below 18 years of age, without verifiable consent of a parent or lawful guardian, and we do not undertake tracking, behavioural monitoring or targeted advertising directed at children.
Where an applicant to our campus ambassador programme or a similar programme is below 18, we will require verifiable consent of a parent or lawful guardian before proceeding, and we will not engage that person in any paid capacity without it.
If you believe we hold a child’s personal data without such consent, write to the Grievance Officer and we will verify and erase it.
We share personal data only as necessary, and only with:
Data Processors acting on our instructions — namely our website and email hosting providers; our accounting and invoicing platform; payment gateway providers; logistics and courier partners for delivery; and communication tools including WhatsApp Business. Each is engaged under contract and may process personal data only for the purpose for which we disclose it.
Third-party analytics and advertising providers where you have consented to non-essential cookies. These providers may process data outside India under their own terms.
Our contract manufacturer and food safety authorities where a product quality complaint requires batch investigation. In such cases we share only the batch, date and complaint particulars necessary for the investigation.
Professional advisers, auditors and insurers under duty of confidentiality.
Government authorities, courts or law enforcement where disclosure is required by law or necessary to establish, exercise or defend a legal claim.
An acquirer or successor in the event of a merger, reorganisation or transfer of business, subject to this Policy continuing to apply.
Some of our service providers process data on infrastructure located outside India. Where personal data is transferred outside India, we do so only to countries not restricted by the Central Government under the Digital Personal Data Protection Act, 2023, and we require contractual safeguards from the recipient. We will update this Policy if the applicable restrictions change.
We maintain reasonable security safeguards appropriate to the nature and volume of the personal data we hold. These include transport encryption on at1am.com, access control on a need-to-know basis, unique credentials and multi-factor authentication on our official email and accounting systems, logging and monitoring of access to systems containing personal data, and periodic backups.
No system is entirely secure and we do not represent that our safeguards are incapable of being breached. You are responsible for keeping any credentials you hold confidential.
We retain personal data only for as long as necessary for the purpose for which it was collected, or for such longer period as required by law. Specifically: enquiry and support correspondence is retained for 24 months from last contact; unsuccessful job, internship and ambassador applications are retained for 12 months unless you ask us to delete them sooner; trade and distributor records, invoices and tax records are retained for the period prescribed under applicable tax and companies legislation; batch, dispatch and complaint records relating to food safety traceability are retained for the shelf life of the batch plus the period required under food safety law; and access logs are retained for at least one year.
On expiry of the applicable period we erase the personal data or irreversibly anonymise it.
Subject to the Digital Personal Data Protection Act, 2023 you have the right to obtain confirmation of and access to a summary of the personal data we process about you and the processing activities undertaken; to seek correction, completion, updating or erasure of your personal data; to nominate another individual to exercise your rights in the event of your death or incapacity; and to a readily available grievance redressal mechanism.

We will acknowledge your request within 48 hours of receipt and respond within one month, or such shorter period as applicable law requires. Please state clearly what you are asking for and provide enough information for us to locate your records.
If you are not satisfied with our response, you may approach the Data Protection Board of India in accordance with the Digital Personal Data Protection Act, 2023.
If a personal data breach affecting your personal data occurs, we will inform you and the Data Protection Board of India in the manner and within the timelines prescribed under the Digital Personal Data Protection Rules, 2025, and will provide the nature and extent of the breach, its likely consequences, and the measures we have taken to mitigate it.
